Pool ioniser update - 24 December 2004

On 23 December 2004 the Administrative Appeals Tribunal determined that the APVMA should issue permits authorising the possession, supply and use of the electrode and oxidiser components of the Aquabrite and Questa Poolfresh systems. The permits will require the suppliers to warn customers about the APVMA’s concerns and recommend the use of chlorine in conjunction with the ionising systems. Meanwhle the suppliers will need to pursue registration of their products, which requires them to demonstrate the efficacy of their products as pool and spa sanitisers. On 30 June 2004 the Administrative Appeals Tribunal confirmed the APVMA's decision that components of the Questa PoolFresh and Aquabrite systems, the electrodes and the oxidiser, are chemical products that are regulated by the APVMA. On 14 September, the AAT confirmed that the APVMA regulates the electrode used with Floatron. The APVMA's authority to regulate these products has been unsuccessfully challenged. The APVMA's position is that it regulates the chemical components of pool ioniser systems, even if the system contains non-chemical components such as electrical devices.
