Who can make an FOI request?

Any person may apply for access to documents held by the APVMA under the Freedom of Information Act 1982.

Is there a form that I must use?

No. However, the request must:

• be in writing;
• be accompanied by a $30 application fee (may be remitted in certain circumstances);
• state an address in Australia to which notices under the FOI Act can be sent; and
• describe with sufficient clarity the documents (as opposed to information) sought to enable the APVMA to identify those documents.

Is there a charge for processing my FOI request?

Yes, you will be notified of the estimated amount after the APVMA has identified the documents and estimated the amount of work required to process your FOI request. The charge may be waived in certain circumstances.

How long will it take for the APVMA to process my FOI request?

The time taken to process an FOI request is prescribed by the FOI Act and varies significantly depending on many factors, including:

• the nature of documents sought;
• how easily the APVMA can ascertain from your description what documents you seek; and
• how quickly you pay the charges when notified (or, if you apply for the charges to be waived, how quickly that application is resolved).

Generally, if the documents sought do not contain information about third parties, it will take the APVMA around 30 days to process the request. Otherwise, it will take the APVMA around 60 days to process the request. (Please note that this is only a rough estimate.)
